These Terms of Service ("Terms") govern your access to and use of CueMind's services, including our website, applications, and AI features (collectively, the "Services"). By using the Services, you agree to these Terms.
1. Eligibility and Accounts
You must comply with all applicable laws when using the Services. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.
2. Your Content
You retain ownership of content you submit to the Services, subject to the rights necessary for us to provide and improve the Services in accordance with our Privacy Policy.
3. AI Video Generation Terms
If you use CueMind's video generation features, the following additional terms apply:
- You must own or have full legal authorization to use all input materials you upload or provide for generation, including images, video clips, and audio. You are responsible for ensuring such materials do not infringe any third party's intellectual property rights, portrait rights, voice rights, or other personal rights.
- You must not use video generation to create content that infringes third-party intellectual property rights, personality rights (including portrait and voice rights), or reputational rights.
- If your input materials include the likeness or voice of a real person, you must obtain that individual's explicit prior consent before upload or use.
- AI-generated output may not be unique. Other users of the same underlying models may receive similar or identical outputs. You waive any claim against CueMind and CueMind's infrastructure providers arising from such similarity.
- You are solely responsible for evaluating the accuracy, legality, and suitability of AI-generated output for your specific use case before you use, publish, or distribute it.
- CueMind video generation relies on third-party model infrastructure. Your use of this feature is also subject to the acceptable use policies and related rules of those providers. CueMind may suspend or terminate your access to video generation if you violate these Terms or applicable upstream provider terms.
4. Prohibited Conduct
You may not use the Services to violate law, infringe rights, harass others, distribute malware, or interfere with the security or operation of the Services.
5. Third-Party Services
Portions of the Services may rely on third-party infrastructure and providers. CueMind is not responsible for independent third-party websites or services that are not controlled by CueMind.
6. Disclaimer of Warranties
The Services are provided on an "as is" and "as available" basis to the maximum extent permitted by law. CueMind disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.
7. Limitation of Liability
To the maximum extent permitted by law, CueMind and its affiliates, officers, employees, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, data, goodwill, or business opportunities arising from or related to your use of the Services.
8. Suspension and Termination
We may suspend or terminate access to the Services at any time if we reasonably believe you have violated these Terms, created legal risk, or harmed other users, CueMind, or third parties.
9. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will post the updated version with a revised effective date. Your continued use of the Services after updates become effective constitutes acceptance of the updated Terms.
